I have been thinking about the first note for quite some time. Initially, I planned to structure it following the typical flow of a project, from corporate matters to litigation. However, this approach doesn’t seem reasonable for such a specialized sector. If a client asks me about a RE project in Vietnam, the first thing I would check is inspection reports. :)

(1) A key takeaway for investors and lawyers is the importance of thoroughly familiarizing themselves with the inspection reports on RE projects in Vietnam, issued by the Government Inspectorate and some available online. These reports highlight recurring challenges, including compliance with the master plan, land-use rights, licensing procedures, construction and other regulatory issues.
(2) Furthermore, it is important to delve deeper into the working minutes and reports of EVN, the Ministry of Industry and Trade (MOIT), the Government, and other regulatory bodies related to the findings in the inspection reports. These documents offer critical insights into the perspectives of relevant authorities on addressing the issues in a high level.
(3) Additionally, during the LDD process, the investors and lawyers ahould request all meeting minutes and working documents, sanction decisions, rectification status regarding the findings of the target projects, if any. These records may provide further context on the inspectorate’s focus areas, the developer's responses, reveal compliance challenges, regulatory breaches, or project-specific risks.
(4) Last but not leats, staying informed about the sector’s regulatory framework and market updates is equally important. Monitoring changes in policies, such as DPPA, bidding mechanisms or updates on grid capacity constraints, ensures that advice remains practical and forward-looking.
In this niche sector, a meticulous approach to LDD, combined with a clear understanding of market dynamics, is essential to advising clients effectively and facilitating the growth of renewable energy in Vietnam.
